GROUNDS FOR DIVORCE IN NEW BRUNSWICK

Grounds for an online divorce using OnlineDivorce.com are the same as they would be for any divorce within the Province of New Brunswick. Grounds are merely the reason for divorce, and the province must approve them.

There are three possible grounds (or reasons) for a divorce in Canada; they are as follows:

  1. Living separately and apart for at a minimum of one year before the divorce is finalized. This is considered a the no-fault basis for divorce. The divorce may be filed before the full year has passed, but the final judgment will not be issued until after the one year has completely passed. Please note that it is possible to live separate and apart while still living in the same home and under the same roof. This occurs when at least one of the spouses intends for there to be a separation and there is some manner of separation. In most cases, the court will not question this issue.
  2. Adultery (Also known as infidelity or marital misconduct)
  3. Cruelty.

The last two grounds are only available as a choice to the filing spouse. Therefore, if you are the spouse who commits adultery, you cannot be the spouse who requests the divorce utilizing the adultery grounds. The second and third grounds do not have the one-year time limit but are more difficult to establish, and the court will often question them, and they may require evidence regarding them. Using these grounds can also make it impossible, in some case, to file a divorce using a joint petition, which simplifies and speeds up the process.

 

RESIDENCY

Every province has specific requirements in which divorcing couples must establish residency within for the divorce to be finalized. New Brunswick is not an exception.

You may file in New Brunswick, assuming that either spouse has resided within for at least the past year. As far as which locality you choose to file in, you can record where either spouse has lived, but if there are children involved in the case, you will need to file where the children live.

If the residency must be proven, there are several different ways to demonstrate that it has been established.
